Terms of Use

This policy defines the actions that we consider to be abusive, and thus, strictly prohibited. It has been formulated with the following goals in mind:

• Ensure security, reliability and privacy of our systems and network.
• Avoid situations that may cause us to incur civil liability.
• Maintain our image and reputation as a responsible organization.
• Encourage the responsible use of web surveys and discourage practices which degrade the usability of web surveys.

The examples provided in this document are non-exclusive, and are provided solely as guidance for users of our software and hosting services. If you are unsure of the permissibility of a contemplated use or action, please contact us and we will assist you.

Infringements of this policy may result in one or more of the following:

• A warning from us via email, phone call, or voice message.
• Temporary shutdown of service including suspension of data collection for your surveys, and/or distribution of your outbound email messages.
• Permanent disconnection of service without refund.

General Conduct

You are prohibited from transmitting on or through any of Vovici's services any material that is, in our sole discretion, unlawful, obscene, threatening, abusive, libelous, or that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law.

Our software and hosting services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. Vovici reserves the right to remove such illegal material from its servers.

You are responsible for keeping you billing and contact information up-to-date and accurate. Furnishing false information on any form, contract or application, including fraudulent use of credit card numbers, is grounds for immediate termination, and may subject you to civil or criminal liability.

You are not permitted to share your personal account with another party. Unless specifically stated in writing to the contract, all accounts hosted by us are designed for use by one person. Sharing your user ID and password with other people is grounds for immediate termination of your account without a refund.

You are permitted to allow access to software licensed by us and run on your on computer network to anyone that is a full time employee, contractor, student, or agent acting solely for the benefit of you or your employer. Allowing access to anyone else is grounds for immediate termination of your license without refund.

The resale of our products and services is not permitted, unless specifically permitted and documented in a written Reseller Agreement with Vovici Corporation.

SPAM

We have a zero tolerance for Unsolicited Commercial Email (a.k.a. SPAM or UCE). Please refer to the Vovici Anti-SPAM policy for specific guidelines.

Security

At no time shall you attempt to circumvent user authentication or other security measures relating to our software and hosting services, nor shall you use our software or hosting service to attempt to circumvent security measures relating any other user, host, or network. This includes, but is not limited to, accessing data not intended for you, logging into a server or account using a user ID and password of another person, password cracking, probing the security of other networks in search of weakness, or violation of any other organization's security policy.

You may not attempt to interfere with or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network.

We will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. You may incur criminal or civil liability if you violate or attempt to violate systems or network security.

Images

We provide you limited storage facilities on our hosting service for images used in conjuction with your surveys hosted on our hosting service. You are prohibited from using this image storage facility for non-survey purposes and you are not allowed to reference any image stored on our hosting service by anything other than a survey hosted on our hosting service.

Failure to follow these guidelines may result in
termination of your service or software license agreement.
